Cone-Jack™ Limited Warranty
Cone-Jack™ Products, Inc. ("Cone-Jack™") warrants to you the undersigned and or end user ("Owner") of its products, subject to the terms, conditions, and limitations set forth herein, for a period of (1 one) year from the date the product was manufactured, that said products shall be free from any defect in workmanship. Materials are provided by the customer and must be in excellent condition. The products of Cone-Jack™ include all and only those produced by it and does not apply to labor, or construction costs associated with re-installation of a defective unit.
Terms, Conditions & Limitations
- Upon inspection any unit found to be defective should be returned to Cone-Jack™ along with a photograph of each product and its defect for replacement or repair. Defects must be reported in writing upon discovery.
- This warranty does not extend to Cone-Jack™ products damaged while being transported or otherwise handled by the owner. This exclusion also applies to damage caused by improper handling and installation.
- The remedy stated herein, replacement or repair of the product by Cone-Jack™, is the sole and exclusive remedy for failure of the product purchased by the owner. Cone-Jack™ shall under no circumstances be liable for incidental or consequential damages including, but not limited to damages to the building or the contents of the building on which its product is utilized.
- There are no express warranties, except those stated herein, and there are no implied warranties of any kind, including implied warranties of merchantability and fitness for a particular purpose. No Cone-Jack™ representative has authority to make any representations other than those stated herein.
- This warranty shall not be applicable to damage or loss caused in whole or in part by: (A) Natural disasters, including lightning, high winds, hail, hurricanes, acts of GOD, or similar natural disasters; (B) Vandalism, acts of war, or civil disturbances; (C) Over-exposure to commercial/industrial solvents, acids, bleaches, or other harmful chemicals; (D) Failure of any materials (E) Deterioration or failure of any building component, including, but not limited to, the roof, substrate, walls or mortar; (F) Over-exposure to tar, animal fats, or any petroleum product; (G) Over-exposure to heated vents or chimneys.
- This warranty is for the benefit of the purchaser and the end user, and may not be transferred upon change of ownership after installation without the written consent of Cone-Jack™.
- Any claim or dispute between owner and Cone-Jack™ arising out of this warranty or relating to any product supplied by Cone-Jack™ shall be resolved by final and binding arbitration in accordance with the then current rules of the American Arbitration Association.
- This warranty is not valid unless it is signed by the owner and Cone-Jack™ representative.
